Terms of service

These terms are an agreement between TML Consulting Services LLC, a California limited liability company, of 1934 Meridian Blvd., Mammoth Lakes, CA 93546 (“we”, “us”), and the business that uses OwnPoint (“you”). By creating an account or using OwnPoint, you agree to them. If you have signed a purchase agreement with us, that agreement wins wherever it and these terms disagree.

1. What OwnPoint is

OwnPoint is point-of-sale software for counter-service shops. It rings sales, takes cash and card payments, prints receipts, tracks products and stock, runs staff schedules and time clocks, keeps customer and loyalty records, and reports on all of it. We host it for you; you reach it in a web browser.

2. Your account and your staff

  • The owner account is responsible for everyone it adds. You choose who works on your tills and what each person may do.
  • Keep passwords and PINs private. Tell us at mark@ownpointpos.com if you think someone has used your account without permission.
  • The information you give us about your business must be true and kept up to date.

3. Fees

OwnPoint is sold for a one-time licence fee plus a monthly hosting fee. The amounts, when they are due and how they are paid are set out in your invoice or order form. There are no tiers and no paid add-ons, and no minimum term: you can cancel at any time. If a fee is still unpaid 30 days after it is due, we may suspend your account until it is paid. The one-time licence fee is non-refundable, and we do not refund the monthly fee for part of a month.

4. Card payments are between you and Stripe

Card payments are processed by Stripe, Inc. under your own Stripe account and Stripe’s own terms, which you accept with Stripe directly. We are not in the payment path: we never hold your money, and card numbers never reach our systems. Payouts, processing fees, chargebacks, disputes, account holds and verification requests are between you and Stripe.

5. When the internet goes down

The till is built to keep selling through a short outage: cash sales are recorded on the device and uploaded when the connection returns. Card payments are different. Only the customer’s bank can approve a card, and reaching the bank needs a connection, so card payments cannot be taken while the till is offline.

6. Your data is yours

You own everything you put into OwnPoint: your sales, products, inventory, customers, staff records and reports. You can export all of it, in standard file formats, at any time, from Reports → Export, without asking us. If you leave, you leave with everything. How we handle that data is in our privacy policy.

You give us permission to store and process your data only to run OwnPoint for you, back it up, keep it secure and support you.

7. What you are responsible for

  • Your tax rates, prices and receipts. OwnPoint applies the rates you set; whether they are right for where you trade is yours to check.
  • Your obligations to your staff: wages, overtime, breaks and recordkeeping under the labor laws that apply to you. The schedule and time clock are tools, not payroll or legal advice.
  • Your obligations to your customers, including telling them how you use their information and honoring their choices about marketing email.
  • Your devices, internet connection, printers, card readers and cash drawers.

8. Acceptable use

Do not use OwnPoint to break the law, to sell anything unlawful, to send email people have not agreed to receive, to reach another business’s data, or to probe, overload or copy the service. We may suspend an account that does, and will tell you why.

9. The assistant

OwnPoint includes Ace, an assistant that answers questions about the product and your store. Its answers are generated by an AI model and can be wrong. Check anything that matters, especially money, tax and staff pay, against your own records.

10. Availability and changes

We work to keep OwnPoint available and back it up every night, but we do not promise it will never be interrupted, and we make no uptime commitment. We release updates overnight, outside trading hours, and may improve or change features; we will not take away your ability to export your data.

11. Ending the agreement

You may stop using OwnPoint at any time by emailing mark@ownpointpos.com. We may end this agreement on 30 days’ written notice, or immediately if you seriously break these terms. Either way, you will have 30 days after it ends to export your data; after that we delete it, and the copies in our backups age out as described in the privacy policy.

12. Warranties and liability

OwnPoint is provided “as is”. To the extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

To the extent the law allows, our total liability for anything arising from these terms or your use of OwnPoint is limited to the fees you paid us in the 12 months before the claim arose, and we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.

13. Changes to these terms

If we change these terms, we will post the new version here, update the date at the top, and tell account owners by email 30 days before a material change takes effect.

14. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be heard in the courts of Mono County, California.
